By accessing or using HSA Butler (“Service”), operated by HSA Butler (“Company,” “we,” “our,” or “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use our Service.

2. Description of Service

HSA Butler is a web-based health expense tracking application that helps users manage their Health Savings Accounts through expense categorization, receipt storage, and compliance documentation. The Service includes features for tracking medical expenses, storing receipts, generating reports, and ensuring IRS compliance.

3. User Accounts

3.1 Account Creation

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized access to your account
  • You must be at least 18 years old to create an account

3.2 Account Responsibility

  • You are solely responsible for all activities that occur under your account
  • You agree to use the Service only for lawful purposes
  • You will not share your account with others or allow others to access your account

4. Subscription and Payment Terms

4.1 Subscription Plans

  • HSA Butler offers various subscription plans with different features and limitations
  • Free plans may have restrictions on the number of expenses or receipts
  • Paid subscriptions provide additional features and unlimited usage

4.2 Payment Processing

  • Subscription fees are billed in advance on a monthly or yearly basis
  • All payments are processed through secure third-party payment processors
  • Fees are non-refundable except as expressly stated in these Terms

4.3 Automatic Renewal

  • Subscriptions automatically renew at the end of each billing period
  • You may cancel your subscription at any time through your account settings
  • Cancellation takes effect at the end of the current billing period

4.4 Price Changes

  • We reserve the right to modify subscription prices with 30 days’ notice
  • Price changes will not affect existing subscriptions until the next renewal period

5. Acceptable Use Policy

5.1 Permitted Uses

  • Track legitimate medical expenses for personal Health Savings Account management
  • Store receipts and documentation for healthcare-related expenses
  • Generate reports for tax and compliance purposes

5.2 Prohibited Uses

You agree NOT to use the Service to:

  • Upload false, fraudulent, or misleading expense information
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Transmit malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems or other users’ data
  • Use the Service for any commercial purpose other than personal HSA management

6. Data and Privacy

6.1 Your Data

  • You retain ownership of all data you upload to the Service
  • We process your data in accordance with our Privacy Policy
  • You grant us a limited license to process your data to provide the Service

6.2 Data Security

  • We implement industry-standard security measures to protect your data
  • However, no system is completely secure, and we cannot guarantee absolute security
  • You are responsible for maintaining the security of your own devices and networks

6.3 Data Backup and Loss

  • We regularly backup user data but recommend maintaining your own copies

7. Intellectual Property

  • HSA Butler and all related trademarks, logos, and content are our property
  • The Service’s software, design, and functionality are protected by intellectual property laws

  • You represent that you have the right to upload and use all content you submit

8. Service Availability and Modifications

8.1 Service Availability

  • We strive to maintain high uptime but do not guarantee uninterrupted service
  • Scheduled maintenance may temporarily affect service availability
  • We will provide reasonable notice for planned maintenance when possible

8.2 Service Modifications

  • We may modify, update, or discontinue features of the Service at any time

  • Continued use of the Service constitutes acceptance of modifications

9. Disclaimers and Limitations

  • HSA Butler is a tracking tool and does not provide tax, legal, or financial advice

9.3 Limitation of Liability

  • Our liability is limited to the amount you paid for the Service in the 12 months preceding the claim
  • We are not liable for indirect, incidental, or consequential damages
  • Some jurisdictions do not allow limitation of liability, so these limits may not apply to you

10. Indemnification

You agree to indemnify and hold harmless HSA Butler, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any content you submit to the Service

11. Termination

11.1 Termination by You

  • You may terminate your account at any time through account settings
  • Upon termination, you will lose access to the Service and your data
  • You may export your data before termination

11.2 Termination by Us

We may terminate or suspend your account immediately if you:

  • Violate these Terms of Service
  • Engage in fraudulent or illegal activities
  • Fail to pay subscription fees
  • Abuse or misuse the Service

11.3 Effect of Termination

  • Upon termination, your right to use the Service ceases immediately
  • We may delete your data after a reasonable period following termination
  • Provisions regarding intellectual property, disclaimers, and limitations survive termination

12. Dispute Resolution

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HSA Butler.

13.4 Amendments

We may update these Terms from time to time. Material changes will be communicated through email or in-app notifications. Continued use constitutes acceptance of updated Terms.

13.5 Assignment

You may not assign your rights under these Terms. We may assign our rights to any affiliate or successor entity.

13.6 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
